Addressing tenant issues has taken on a world of its own. There are the relatively new state laws encapsulated in AB1482 which provide significant tenant protections. Further, there is the potential that each of California’s 58 counties and 482 cities may have enacted their own tenant protection laws. When selling a property, Fiduciaries are often faced with the dilemma of how to handle tenants in the properties they are preparing to sell…should you/could you ask persons residing in the property to move? This presentation will review the law, how to handle tenants, caregivers and family members residing in the property. Recent caselaw found an owner liable over $1 million for an improper eviction and included an Elder Abuse cause of action. Understanding the Tricks and Traps in Evicting Persons in Preparation of a Sale will provide the fiduciary with the information to make an informed decision on the rights of the owner and the tenant.
