Cultural Diversity And Ethics

We have a unique profession in that we do not provide a one-time service but instead provide multiple services and care across the person’s lifetime. Our practice is enhanced when we have greater insight into and respect for the person’s culture, religion, gender, sexual orientation, ethnicity, etc. Attendees will learn how to do an ethnographic interview, how diversity within and across cultures affects decision making, and how our own perspective may be influencing our practice.

Viki Kind, M.A. – Kind Ethics

Viki Kind is a clinical bioethicist, professional speaker and hospice volunteer. Her award-winning book, The Caregiver’s Path to Compassionate Decision Making: Making Choices For Those Who Can’t, guides families and professionals who are making decisions for those who have lost capacity. Viki is known as “The People’s Bioethicist,” because she is a rare individual who bridges two worlds, that of the health care professional and of the family struggling to make the right decision. She is an honorary board member of the Well Spouse Association and has been a caregiver for many years for six members of her family.

About the Session

Are you aware of the situations which create conflicts of interest? Can you clearly identify who is the client, and to whom you owe fiduciary duties, including the duty of confidentiality? What about attorneys who refer you cases and who may owe duties to you and to others? This is the course for identifying and handling conflicts of interest and avoiding lawsuits! We will examine common conflict of interest situations and how to resolve them (including conflicts of interest created by your attorney!). We will also provide checklists for fiduciaries to use when they first take cases to determine whether they are safe from actual or potential conflicts of interest.

Navigating the Regional Center System

Jim Huyck, former Executive Director of Alta California Regional Center, will present on Navigating the Regional Center system. This will include the history and creation of the Regional Centers including how parents paid a key role in their establishment. Jim will explain the two programs that the Regional Centers administer and the eligibility criteria for both programs. The Individual Program Planning process will be explained and how services are agreed to and authorized by the Regional Center. The various services which the Regional Center can provide will be detailed. The current fees that parents can be charges will be explained. The process of Institutionally Deeming children, who would otherwise not be eligible for MediCal, onto MediCal through the MediCaid Waiver process, will be explained. Also explained will be the process for appealing any denial of requested services. Of great interest to the audience will be whether the Regional Centers require that Special Needs Trust pay for services rather than the Regional Center paying for the services.

Jim Huyck has over 40 years of experience working with people with disabilities, primarily those with Developmental Disabilities. He began his career as a Senior Rehabilitation Counselor with the California Department of Rehabilitation, working with Regional Center clients. After 5 years, he was hired by the San Diego Community College District as a Counselor for the “Limited Learners” (Regional Center clients). He was promoted to Associate Dean of Special Education at the San Diego Community College District where he served until he was recruited to Sacramento by the California Community College Chancellor’s Office where he launched the Statewide Foundation for the California Community Colleges. During his tenure there he was successful in obtaining grants and contracts totaling over $17 million per year including funding from Apple and IBM to establish High Tech Centers for the Disabled at Community Colleges Statewide. In 1995 he was hired as the Executive Director of Alta California Regional Center where he served for 10 years, managing a staff of over 300 employees and an annual budget of $175 million. For the past 12 years he has been consulting and advocating for individuals with disabilities and their families to assist in accessing public benefits including Regional Center, SSI, SSDI, MediCal, IHSS, Special Education, CCS etc. In particular he works closely with attorneys and Trustees as a Consultant regarding Special Needs Trust.

About Merrianne E. Dean

Merrianne E. Dean, Esq. has more than two decades of courtroom experience litigating probate and trust disputes, financial elder abuse matters, conservatorships and business disputes. Her work also includes representing executors and trustees in the administration of trust, probate estates, and conservatorships. Ms. Dean was admitted to the State Bar of California in 1994 and has practiced in the area of Trust & Estates since 1997. Ms. Dean is a California State Bar Certified Specialist in Estate Planning, Trust, and Probate Law. Ms. Dean has been a member of the San Diego Probate Bench Bar Committee since 2004 and has served as a court-appointed attorney in conservatorship matters for more than 15 years.
